Kurikara ruling question

Kurikara has been banished by called by the grave during battle phase. My opponent summons another kurikara mp2 but called by negates the effect of kurikara. Judge says that the summon is legal since it is a summoning condition. I still dont get it, if the effect is negated then why does kurikara still summon?
