Are they really confiscating gender change application documents?

I am in the US. I know that they're no longer processing applications with gender change requests but I heard somewhere that they're also confiscating documents sent along with gender change passport applications? I had to send in a copy of my name change order as well as my passport which was unexpired. I can get a million copies of my name change order but what do I do if they never return my passport to me?
