Apple AirPods Max vs CGA

I have some AirPods Max that I got 3.5 years ago. The headband fabric has lost all elasticity rendering them extremely uncomfortable. The headband can’t be replaced with an original part. Considering these were ~$900 and headphones, I’d expect them to last 5+ years. Where do I stand with the consumer guarantees act on getting the entire unit replaced?

I’d get them fixed with an original part, but unless I buy another pair of headphones that isn’t possible.

Where do I stand legally on a replacement because under fair use they shouldn’t be putting me in pain at this age
