Passenger in car accident
My boyfriend and I were in a car accident over the weekend that totalled his vehicle. I was the passenger. The roads were complete ice and the other driver was in the incoming lane, came around a bend in the road, turned sideways, slid at us, hit our vehicle, then went into the ditch on our side of the road. He was perfectly fine, I don't even think his airbags went off. All of our airbags deployed, our whole front end is smashed in, and the car is not drivable/ won't even turn on. My boyfriend and I were transported to the hospital in an ambulance and discharged after some imaging was done and we both came back with nothing broken and no internal bleeding. I have severe bruising/ a hematoma where the seatbelt was, and a lot of soreness in my neck/back/chest/abdomen. My boyfriend has soreness in his neck/chest/abdomen/back. I ended up having to go back in about 5 hours after I was discharged from the hospital due to vomiting. When I got there my heart rate was elevated (SVT) and they kept me for observation. They did more testing and ended up transporting me via ambulance to a trauma unit in another hospital to stay overnight, where I was discharged the next day. They believe my heart rate was due to stress from the whole situation. The other driver's insurance offered me reimbursement for all medical expenses (and they will cover my next 4 medical visits), the meds I paid for out of pocket, 3 days worth of wage reimbursement (I can get more if I need more days off, I just need to submit a doctor's note for the extra days), and $2500 for the inconvenience. The total personal payout is around 3100 not including my medical bills. I'm not sure the total cost of my medical bills yet, but I'm assuming around $6,000. I had just woken up when I was in the phone with them and I believe I agreed to this settlement and wasn't in my right mind to tell them I would need to think about it and call back. I didn't even think to ask about emotional distress/ pain and suffering. I'm reading a lot of mixed things on if this is a fair payout and I'm just looking for advice. Also wondering if I can get compensation for emotional/ pain and suffering if I did already give a verbal agreement?
TDLR; I was the passenger in a car accident and sustained soft tissue injuries (bruising/ soreness) and was offered all medical bills to be paid, they will pay for next 4 visits, and personal payout of $3100 for wage reimbursement and "inconvenience" is this fair?
