68 terabytes of disorganized discovery
Why do you think the prosecution sent the discovery over in such manner?? It is mind boggling that defense is still saying they are waging through discovery after 2 years.
A) data dump strategy-strategy to overwhelm the defense, knowing that sifting through massive amounts of evidence is resource-intensive and time-consuming.
B) legitimate complexity- The case may genuinely involve a large volume of evidence like digital evidence, surveillance, or communications.
C) Insufficient Preparation: evidence was not effectively organized before turning it over possibly due to poor case management or inadequate resources.
D) Stalling or obfuscation -Delay in providing clear and relevant evidence may indicate prosecutorial misconduct intended to disadvantage the defense
Also, with the defense continuously filing motions to compel, and supplemental discovery requests can this lead to the C defense asking for charges to be dismissed based on the defendant not being able to receive a fair trial based on the prosecutors not having/providing evidence they are asking for? In the documents the defense is saying that not having info they are requesting prevents them from properly defending him and they wish extend deadlines so that they have time to prepare.
