[MD] car wreck in rental car

Luckily I'm alive and didn't hurt anyone else. But in the latest snow storm, I swerved off the road and hit the median. Talked to the rental company and I won't be liable for any repairs so that's good. But, 3 different people on the scene told me I should sue based on the tires I was given. Not only are they summer tires but the rear ones were way bald.

I was told they had to actively know the tires were bald and rent it to me anyway for them to be at fault. To that I say "do they not have maintenance checklists that they do before every rental?" Anyway, I've taken lots of pictures. Do I have a case?
